WOODEN ARTICLES: US market import (LACEY ACT)

Protection of environment and wildlife is, since 1900, a crucial point of the American legislation and in particular of the Lacey Act, a conservation law that aims to contrast illegal wildlife, fish and plant traffic in the USA.
Until 2008, however, the issue relative to illegal traffic of lumber was only partially covered by the field of application of the law.
Given the importance of this aspect in protecting wildlife and the environment, the Lacey Act has been amended introducing more stringent requirements to import wood and wooden articles within the USA.

In particular, for products falling within the field of application of the law, a DECLARATION is required, at the time of import, containing information on the species of plant used and its country of origin.
Products covered by Lacey Act will increase in the future and more and more consumer products will be included.
The act enters into force in gradual phases:
- Phase I: April 1, 2009
General description of involved products: wood and articles of wood - Examples: sheets for veneering, wooden tool handles,…
- Phase II: October 1, 2009
General description of involved products: wood and articles of wood, pulp wood - Examples: wooden frames, kitchenware of wood, plywood panels,…
- Phase III: April 1, 2010
General description of involved products: paper, wooden furniture, articles of wood - Examples: wooden bed, wooden kitchen furniture, paper,…

The above mentioned examples are not exhaustive since they don’t cover all the involved products: for the definition of the field of application it is necessary to refer to the HTS classification (Harmonized Tariff Schedule).
